Policy & Agreement

Scope

The following statement represents the agreement and understanding between Tre@SureNET, LLC. (heretofore "Tre@SureNET") and the account holder (hereinafter called Customer) for using Tre@SureNET's services and this supersedes any other written or oral agreement. Upon notice published on-line via Tre@SureNET web site services, Tre@SureNET may modify these terms and conditions, as well as discontinue or change services offered. If Customer does not agree to these terms and conditions, please notify our Customer Department at 770. 772-MALL. USE OF OUR SERVICE shall constitute your approval.

Responsibilities of Tre@SureNET

Tre@SureNET agree to provide basic link of the Client's web material to the agreed Tre@SureNET's web site for the duration of this agreement. Tre@SureNET will make every reasonable effort to provide Continuous Uninterrupted Service to our Clients while the Clients link their web sites to the server, 24 Hours a day, 365 days a Year.

Tre@SureNET will NOT be held responsible for occasional short term downtime of the Server for maintenance or other authorized services. Furthermore, Tre@SureNET will not be responsible for any unexpected, unanticipated, unwarranted service problems that results. Tre@SureNET agrees to make every reasonable efforts to provide amicable resolution to such conflicts.

Tre@SureNET DOES NOT PROVIDE ANY WARRANTY, either expressed or implied, that the interruptions or errors will NOT occur during the link server availability.

Responsibilities of Client

Customer agrees to defend, hold harmless and expeditiously indemnify Tre@SureNET from any liability, claim, loss, damage or expense arising out of the indemnifying party's breach or violation of any covenant contained in this Policy and resulting from the Customer's use of the service.

Services provided to the Customer by Tre@SureNET may only be used for lawful purposes. Transmission or publication of any information, data or material in violation of any U.S. Federal or state regulation or law is prohibited. This includes, but is not limited to, material protected by copyright, trade secret or any other statute, threatening material or obscene material. Tre@SureNET reserves the right remove any and all materials which infringe on copyright work. Such materials will be removed at any time upon receiving a complaint and or notice of copyright infringement.

Client agrees to notify Tre@SureNET immediately for the change of address of linked pages, or any defective links on the Tre@SureNET pages pointing to the Client's site or pages.

Tre@SureNET accounts cannot be transferred or used by anyone other than the Customer. Customers may not sell, lease , rent or assign the service or parts of the service to any party not named in this Policy.

Customer warrants that any material submitted for publication on Tre@SureNET does not violate or infringe any copyright , trademark, patent, statutory common law or proprietary interest of others or contain anything obscene or libelous. Tre@SureNET reserves the right to remove any and all materials which infringe on copyright work. Such materials will be removed at any time upon receiving a complaint and or notice of copyright infringement.

The Web material will be sole responsibility of the Client unless a separate agreement is made between the Tre@SureNET and the Clients.

Use of these services will involve listing Customer's participation in relevant directories, and Customer expressly grants permission for such listings.

Tre@SureNET reserves the right to:

Payments

Client pays the agreed upon fee charge specified, and all fees are to be made at the inception of this agreement unless separate agreement is made otherwise, at that time of signing this agreement. Fees are to be paid within 14 days of the receipt of the notice of payment unless otherwise agreed between the Client and Tre@SureNET in writing.

Announcements/Notices

Announcements/ Notices will consist of e-mail, fax and or other mail delivery services and will be sent out to the last known address of the Client. Announcements/ Notices will be deemed to have been received by the Client, within five business days after being posted.

Amendments

The terms of this agreement may be amended by Tre@SureNET without individual notice to Clients, provided two week notice is made available on Tre@SureNET's Web site.
